Kindly review these Terms thoroughly, as they constitute a binding contract between us and contain essential information regarding your legal rights, remedies, and obligations.

If you live in the United States or Canada, by agreeing to these Terms, you consent to resolving all disputes with Living Disciple exclusively in small claims court or through binding individual arbitration. You also waive the right to participate in any class actions and to have claims decided by a jury, as detailed in the Dispute Resolution section.

Living Disciple’s mission is to improve lives through mentoring and learning. We empower anyone, anywhere, to create and share educational content (instructors) and to access that educational content to learn (disciples). We believe our marketplace model is the best way to offer valuable educational content to our users. To maintain a safe platform and services for everyone, we have established rules.

These Terms apply to all your activities on the Living Disciple website and other related services (“Services”). If you publish a course on the Living Disciple platform, you must also agree to the Instructor Terms. Additionally, our Privacy Policy outlines how we process personal data of our students and instructors. The Instructor Terms, Privacy Policy, and other Living Disciple policies relevant to your use of our Services are incorporated by reference into these Terms.

Our website may send communications about your browsing to third parties who provide services to Living Disciple. By using our Services, you consent to these communications.

1. Accounts

You need an account for most activities on our platform, including purchasing, accessing, and submitting content. Provide accurate and complete information, including a valid email address. You are responsible for your account and all activities associated with it, including any harm caused by unauthorized use. Keep your password secure and do not share your account. We will only grant account access if you can prove ownership. In the event of a user’s death, their account will be closed.

Students and instructors must be at least 18 years old to create an account on Living Disciple. If you are younger but above the age of consent in your country, invite a parent or guardian to open an account for you. If you create an account in violation of these rules, it will be terminated. Instructors may need to verify their identity before submitting content.

You can terminate your account anytime by following the steps provided. Check our Privacy Policy for details on what happens when you terminate your account. Notify us immediately if you suspect unauthorized use by contacting our Support Team.

2. Content Enrollment and Lifetime Access

Under our Instructor Terms, instructors grant Living Disciple a license to offer their content to students. When you enroll in a course, you receive a license from Living Disciple to view the content through our platform. This content is licensed, not sold, to you, and you cannot resell or share it.

Legally, Living Disciple grants you a limited, non-exclusive, non-transferable license to access and view paid content for personal, non-commercial, educational purposes. Other uses, such as reproducing, redistributing, or modifying the content, are prohibited unless explicitly permitted by Living Disciple in writing.

Students typically receive lifetime access to course content upon enrollment. However, Living Disciple reserves the right to revoke this access if necessary due to legal or policy reasons, such as copyright complaints or violations of our Trust & Safety Guidelines. This lifetime access does not cover enrollments via Subscription Plans or add-on features like teaching assistance or Q&A services.

Instructors cannot grant licenses directly to students; any such direct licenses are invalid and violate these Terms.

3. Payments, Credits, and Refunds

3.1 Pricing

The prices of content on Living Disciple are set according to our Instructor Terms and Promotions Policy.

We often run promotions offering discounted prices for a limited time. The price at checkout is the final price you pay. Logged-in users may see different prices than unregistered users due to exclusive promotions for new users.

Logged-in users see prices in the currency based on their account location, while non-logged-in users see prices based on their current location. We do not display prices in other currencies.

If you are in a country with applicable taxes (sales tax, VAT, etc.), Living Disciple collects and remits these taxes. Prices may include these taxes or have them added at checkout, depending on your location.

3.2 Payments

You agree to pay for the content you purchase and authorize us to charge your debit or credit card, or other payment methods, for those fees. Living Disciple works with payment providers to offer convenient and secure payment options. We may update your payment methods using information from our providers; see our Privacy Policy for details.

Do not use invalid or unauthorized payment methods. If your payment fails but you still access the content, you agree to pay the fees within 30 days of our notification. We reserve the right to disable access to content for which payment is not received.

3.3 Refunds and Refund Credits

If you’re not satisfied with the content you purchased, you can request a refund within 30 days. This does not apply to Subscription Plan purchases, covered in Section 8.4 (Payments and Billing). Refunds may be issued as credits or returned to your original payment method, depending on various factors. No refunds are available after 30 days, except if content is disabled for legal or policy reasons. We may also provide refunds beyond 30 days in cases of account fraud.

To request a refund, follow the steps here. Instructors agree that students can receive refunds.

Refund credits automatically apply to your next website purchase. These credits may expire and have no cash value unless required by law.

If we suspect abuse of our refund policy, such as consuming significant content before requesting a refund or frequent refund requests, we may deny the refund, restrict future refunds, ban your account, or limit service use. If your account is banned or content access is disabled due to violations, you will not receive a refund. More details on our refund policy are available here.

3.4 Gift and Promotional Codes

Living Disciple or our partners may offer gift and promotional codes to students. These codes may be redeemed for credits applied to your Living Disciple account, which can be used to purchase eligible content, or directly for specific content, subject to the terms with your codes.

These codes and credits, along with any promotional value, may expire if not used within the specified period. Gift and promotional codes from Living Disciple are not refundable for cash unless stated in the terms or required by law. Codes from partners are subject to their refund policies. Living Disciple may choose which credits to apply to your purchase if you have multiple saved credits. For more details, check our Support Page and the terms included with your codes.

4. Content and Behavior Rules

You may not use the Services or create an account for unlawful purposes. Your use must comply with local or national laws, and you are responsible for knowing and following these laws.

Students can ask questions, post reviews, and submit homework or tests, but must only post original content. Instructors can publish content and communicate with students, but must follow the law and respect others’ rights. Instructors are responsible for their content and actions on the platform and must understand copyright restrictions.

If your content violates laws, rights, or our Trust & Safety Guidelines, or is deemed inappropriate, it may be removed. Living Disciple complies with copyright laws; see our Intellectual Property Policy for more details.

We may restrict or terminate your access to our platform and Services at any time, with or without notice, for any reason, including violations of these Terms, non-payment of fees, fraudulent activities, law enforcement requests, inactivity, technical issues, or any other reason. We may delete your account and content, and block your access. Your content might still be available even if your account is terminated. We are not liable for terminating your account, removing content, or blocking access.

If someone infringes your copyright or trademark rights, let us know. Instructors must respect intellectual property rights. For details on filing a claim, see our Intellectual Property Policy.

5. Living Disciple’s Rights to Content You Post

The content you post as a student or instructor remains yours. By posting it, you allow Living Disciple to reuse and share it, but you retain ownership rights. Instructors should understand the content licensing terms in the Instructor Terms.

By posting content, comments, questions, reviews, or submitting ideas for new features, you authorize Living Disciple to use, share, distribute, promote, and modify this content on any platform and media.

Legally, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, publish, display, and distribute your content (including your name and image) in any media. This includes sharing your content with partners for syndication and marketing purposes. You waive any privacy or publicity rights related to these uses, as permitted by law. You confirm you have the rights to authorize us to use your content and agree to these uses without compensation.

6. Using Living Disciple at Your Own Risk

Our platform does not review or edit content for legal issues and cannot determine its legality. We do not control the content on the platform and do not guarantee its reliability, accuracy, or truthfulness. You use content at your own risk.

You may encounter content you find offensive or objectionable. Living Disciple is not responsible for preventing such content or liable for your access to it. This includes health and wellness content, which carries inherent risks. By accessing it, you assume those risks, including illness or injury.

Be cautious when sharing personal information with students or instructors. We do not control what users do with the information they obtain. Do not share your email or other personal details for your safety.

We do not employ instructors and are not liable for interactions between instructors and students, including disputes or damages.

Our Services may contain links to third-party websites, which we do not control. We are not responsible for their content or practices. Review their terms and privacy policies separately.

7. Living Disciple’s Rights

All rights, titles, and interests in the Living Disciple platform and Services, including our website, applications, APIs, databases, and employee or partner content (excluding instructor and student content), are the exclusive property of Living Disciple and its licensors. Our platforms and services are protected by copyright, trademark, and other laws. You have no right to use Living Disciple’s name, trademarks, logos, domain names, or brand features. Any feedback you provide is voluntary and we can use it without obligation to you.

You may not:

  • Access, tamper with, or use non-public areas of the platform, Living Disciple’s systems, or service provider systems.
  • Disable, interfere with, or circumvent platform security features, or probe, scan, or test system vulnerabilities.
  • Copy, modify, create derivative works of, reverse engineer, or attempt to discover any source code or content on the platform.
  • Access or search the platform by any means other than our provided search functionalities or APIs, including using automated means like scraping or robots.
  • Use the Services to send deceptive or false information, interfere with user access, or disrupt the Services (e.g., by sending viruses, overloading, spamming, or mail-bombing).

8. Subscription or Membership Terms

This section includes additional terms for using our subscription-based collections (“Membership Types”). By using a Subscription Plan, you agree to these terms. Note that Living Disciple Business is governed by the agreement between Living Disciple and the subscribing organization, not these Terms.

8.1 Subscription Plans

During your subscription to a Subscription Plan (Membership Type), you receive a limited, non-exclusive, non-transferable license to access the included content via our Services. The “Content Enrollment and Lifetime Access” terms also apply, except for the lifetime access grant.

Your subscription determines the scope, features, and price of your access, and you cannot transfer, assign, or share it with others.

We reserve the right to revoke your license to use Subscription Plan content for legal or policy reasons at any time. More details on revocation are in the “Content Enrollment and Lifetime Access” section.

8.2 Account Management

You may cancel your subscription (membership) by following the steps on our Membership Account Page. Your access will end on the last day of your billing period. No refunds or credits will be issued for fees already paid, unless required by law. Cancelling your subscription does not terminate your Living Disciple account.

8.3 Free Trials & Renewals

Your subscription (membership) may start with a free trial, the duration of which will be specified during sign-up. Eligibility is determined by Living Disciple at our discretion, and we may limit or terminate the trial if you’re not eligible.

At the end of the free trial, we will charge the subscription fee for the next billing cycle. Your subscription will automatically renew according to your settings unless you cancel before the trial ends. For details on fees and trial periods, visit our Support Page.

8.4 Payments and Billing

The subscription fee (membership fee) will be listed at purchase. For details on fees and dates, visit our Support Page. Taxes may be added as described in “Payments, Credits, and Refunds.” Payments are non-refundable, and there are no credits for partially used periods unless required by law. Check our Refund Policy for details.

To subscribe, provide a payment method. By subscribing, you authorize us and our payment providers to process payments using your provided billing information. Your subscription will auto-renew at the end of each term, charging the current fee to your payment method.

If we update your payment method, you authorize continued charges to it. If payment fails or you file a successful chargeback, we may suspend or terminate your subscription.

We can change Subscription Plans (Membership Types) or pricing at our discretion, with changes taking effect after notifying you, unless otherwise required by law.

8.5 Subscription Disclaimers

We do not guarantee the availability or minimum amount of content in any Subscription Plan (Membership Types). We may add, modify, or terminate features or Subscription Plans at any time. We are not responsible for preserving or storing content you input while using a Subscription Plan. These disclaimers are in addition to those in the “Disclaimers” section below.

9. Miscellaneous Legal Terms

9.1 Binding Agreement

By registering, accessing, or using our Services, you agree to enter into a legally binding contract with Living Disciple. If you do not agree to these Terms, do not use our Services.

If you are an instructor using our Services on behalf of an organization, you represent that you are authorized to do so.

These Terms, including linked agreements and policies, constitute the entire agreement between you and us (including Instructor Terms and Promotions Policy, if applicable).

If any part of these Terms is found invalid or unenforceable, the rest will remain in effect with a valid provision replacing the invalid one.

Delays or failures in exercising our rights do not waive our rights, and we may enforce them later. Waiving rights in one instance does not mean we waive them generally or in the future.

The following sections survive termination of these Terms: Content Enrollment and Lifetime Access, Living Disciple’s Rights to Content You Post, Using Living Disciple at Your Own Risk, Living Disciple’s Rights, Subscription Disclaimers, Miscellaneous Legal Terms, and Dispute Resolution.

9.2 Disclaimers

Our platform may be down for maintenance or due to issues. Instructors may make misleading statements, and we may encounter security problems. You accept that you have no recourse against us in such cases.

The Services and their content are provided “as is” and “as available.” We and our affiliates, suppliers, partners, and agents make no warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and disclaim any implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee specific results from using the Services, and your use is at your own risk. Some jurisdictions don’t allow the exclusion of implied warranties, so some exclusions may not apply to you.

We may discontinue certain features of the Services at any time and for any reason. We and our affiliates, suppliers, partners, or agents are not liable for any damages due to interruptions or unavailability.

We are not responsible for delays or failures in performance due to events beyond our control, such as war, natural disasters, outages, or government restrictions.

9.3 Limitation of Liability

Using our Services involves risks, such as potential injury from health and wellness content. You accept these risks and agree not to seek damages from us for any loss or damage.

Legally, to the extent permitted by law, we and our affiliates, suppliers, partners, and agents are not liable for indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death). Our liability is limited to the greater of $100 USD or the amount you paid us in the 12 months before the event causing the claim. Some jurisdictions don’t allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above may not apply to you.

9.4 Indemnification

If your actions cause us legal trouble, we may take legal action against you. You agree to indemnify and hold harmless Living Disciple, our affiliates, and their officers, directors, suppliers, partners, and agents from any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from: (a) your posted content; (b) your use of the Services; (c) your violation of these Terms; or (d) your violation of third-party rights. This indemnification obligation survives the termination of these Terms and your use of the Services.

9.5 Governing Law and Jurisdiction

When these Terms mention “Living Disciple,” they refer to the Living Disciple entity you’re contracting with, determined by your location.

If you’re a student and using our platform, or an instructor, you’re contracting with Living Disciple, Inc., governed by Missouri law, and consent to the jurisdiction of courts in Kansas City, Missouri, USA, unless the “Dispute Resolution” section applies.

9.6 Legal Actions and Notices

No action arising from this Agreement may be brought more than one year after the cause of action has accrued, unless prohibited by law.

Any notice must be in writing and sent by registered mail, certified mail with return receipt, or email (by us to your account email or by you to info@livingdisciple.org).

9.7 Relationship Between Us

You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.

9.8 No Assignment

You may not transfer these Terms or your account rights. For instance, if you registered as a company employee, you cannot transfer your account to another employee. We can assign these Terms to another entity without restriction. These Terms do not grant any rights to third parties. Your account is non-transferable and all rights terminate upon your death.

9.9 Sanctions and Export Laws

You warrant that you (or any entity you represent) are not located in or a resident of any country under U.S. trade sanctions (such as Cuba, Iran, North Korea, Syria, or Crimea, Donetsk, or Luhansk regions) and are not on any U.S. government restricted list.

If you become subject to such restrictions, you must notify us within 24 hours, and we may terminate our obligations to you immediately.

You may not use, export, transfer, or disclose any part of the Services in violation of U.S. or applicable export control and trade sanctions laws. You also agree not to upload controlled content or technology.

10. Dispute Resolution

This Dispute Resolution section (“Dispute Resolution Agreement”) applies if you live in the United States or Canada. Most disputes can be resolved informally, so please contact our Support Team before pursuing a formal legal case.

10.1 Dispute Resolution Overview

Living Disciple aims to resolve disputes with users without formal legal action. If an issue arises, both parties agree to first work diligently and in good faith to reach a fair resolution using the informal dispute resolution process described below. Sometimes, a third party may be needed to resolve the dispute. This Dispute Resolution Agreement limits how disputes can be resolved.

YOU AND LIVING DISCIPLE AGREE THAT ANY DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS, OR THE USE OF THE SERVICES, THAT ARE NOT RESOLVED INFORMALLY MUST BE ADDRESSED IN SMALL CLAIMS COURT OR BY BINDING INDIVIDUAL ARBITRATION, WAIVING THE RIGHT TO A JURY TRIAL AND TO FILE IN ANY OTHER COURT.

YOU AND LIVING DISCIPLE AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS PART OF A CLASS OR REPRESENTATIVE PROCEEDING IN COURT OR ARBITRATION.

This Dispute Resolution Agreement applies to both parties and their agents, attorneys, contractors, employees, and others acting on their behalf. It is binding on heirs, successors, and assigns, and is governed by the Federal Arbitration Act.

10.2 Mandatory Informal Dispute Resolution Process

Before filing a claim, you and Living Disciple must first try to resolve it informally as described below.

The claiming party must send a short, written statement (“Claim Statement”) with their full name, mailing address, email address, details of the dispute, and a proposed resolution (including any monetary claims). Sending a Claim Statement pauses the statute of limitations for 60 days. Send your Claim Statement to Living Disciple via email at info@livingdisciple.org or by certified mail to Living Disciple Attn: Legal, 1020 Walnut Ln, Warrensburg MO, 64093. Living Disciple will respond to your account email unless otherwise requested.

Both parties will attempt to resolve the dispute in good faith within 60 days. If unresolved, either party may then initiate a formal claim in small claims court or individual arbitration. Failure to complete this process is a material breach of the Terms, preventing any court or arbitrator from hearing the dispute.

10.3 Small Claims

Disputes not resolved informally can be brought in small claims court in (a) Kansas City, Missouri; (b) your county; or (c) another agreed location. We waive the right to bring disputes in any courts other than small claims court.

10.4 Arbitration

As an alternative to small claims court, you and Living Disciple can resolve disputes through individual arbitration. An arbitrator can award the same relief as a court and must follow our agreement. If either party brings a dispute to a court other than small claims, the other can request to move it to arbitration. Court proceedings will be paused pending arbitration resolution.

Disputes about arbitration requirements or the scope of the arbitrator’s powers are for the arbitrator to decide. This doesn’t limit challenging improperly started arbitration.

Courts can enforce this agreement and halt improper arbitrations or mediations.

If the American Arbitration Association (AAA) or another arbitrator can’t handle the arbitration, we will negotiate to find a substitute. If we can’t agree, either party can ask a court to appoint a suitable arbitration organization or individual at a comparable cost.

10.5 General Arbitration Rules

The arbitration process varies based on whether your claim is individual or part of a Mass Arbitration. The “General Arbitration Rules” apply except in Mass Arbitration cases.

All arbitrations will be before a single arbitrator. To start arbitration, file a demand with the AAA. Consumer disputes follow the AAA Consumer Arbitration Rules, while others, including instructors, follow the AAA Commercial Arbitration Rules. If there’s a conflict between these Terms and AAA rules, these Terms control.

Disputes under $15,000 USD (excluding attorneys’ fees and certain damages) must be resolved through binding, non-appearance-based individual arbitration based on written submissions. Other arbitrations can be by phone, video conference, or written submissions. An arbitrator’s award can be enforced in any court with jurisdiction.

To begin arbitration with the AAA, send a letter describing the dispute and requesting arbitration to the American Arbitration Association Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043, or file a request online through the AAA website.

10.6 Mass Arbitration Rules

If 25 or more claimants (each a “Mass Arbitration claimant”) or their lawyers file or intend to file arbitration demands against Living Disciple with similar disputes and coordinated legal representation (a “Mass Arbitration”), the following rules apply:

Each claimant must complete the informal dispute resolution process. Counsel must file a single Claim Statement listing all claimants by name, address, and email. A “bellwether procedure” follows, where up to 10 claimants proceed to individual arbitrations, each assigned to a separate arbitrator. Other claims are dismissed without prejudice until the bellwether arbitrations are completed within 120 days. No new demands can be initiated during this period and the subsequent mandatory mediation.

After the bellwether arbitrations, both parties must engage in at least 60 days of non-binding mediation to resolve all disputes. If unresolved, claimants may only pursue disputes individually in small claims court or with FairClaims, Inc., following FairClaims’ Small Claims Rules & Procedures.

If the Mass Arbitration Rules are found unenforceable by a final decision, unresolved disputes must be resolved in court, including potentially as class actions, and cannot be pursued through arbitration. Pending arbitrations must be dismissed without prejudice. This finding does not affect the validity of other provisions in these Terms.

10.7 Fees and Costs

You and Living Disciple agree to bear your own costs and attorneys’ fees in a dispute, unless applicable law allows recovery. If a court or arbitrator finds a claim was made in bad faith or for improper purposes, they may award attorneys’ fees to the defending party.

10.8 No Class Actions

Except as provided under the Mass Arbitration Rules, we agree to bring claims against each other only on an individual basis. This means: (a) no claims as a plaintiff or class member in a class, consolidated, or representative action; (b) no combining of claims by an arbitrator; and (c) an arbitrator’s decision applies only to the individual case, not to others. This agreement does not limit our right to mutually resolve disputes through a class-wide settlement.

10.9 Changes

If Living Disciple changes the “Dispute Resolution” section after your last acceptance, you may reject the change by notifying Living Disciple in writing within 30 days of the change. Send notice by mail to Living Disciple Attn: Legal, 1020 Walnut Ln, Warrensburg, MO 64093, or by email to info@livingdisciple.org from your account email. The notice must include your full name and clearly state your intent to reject the changes. By rejecting changes, you agree to arbitrate any dispute under the terms in effect at your last acceptance.

10.10 Improperly Commenced Arbitration

If either party believes the other has violated this Dispute Resolution Agreement by initiating or threatening arbitration, they may seek a court order to stop the arbitration and recover related fees and costs, including attorneys’ fees.

11. Updating These Terms

We may update these Terms to clarify or reflect new practices, and we reserve the right to modify them at any time. If we make a material change, we will notify you via email or by posting a notice on our Services. Changes become effective on the posting date unless stated otherwise.

Your continued use of our Services after changes take effect means you accept the changes. Revised Terms supersede all previous Terms.

By signing up as an instructor(mentor) on Living Disciple, you agree to these Instructor Terms (“Terms”), which are part of our Terms of Use. Any undefined capitalized terms have the meanings set in the Terms of Use.

As an instructor, you are contracting directly with Living Disciple, LLC. (a Missouri LLC in the United States), even if another subsidiary handles your payments.

1. Instructor Obligations

As an instructor (mentor), you are responsible for all content you post, including lectures, quizzes, exercises, tests, assignments, resources, answers, course content, labs, assessments, and announcements (“Submitted Content”).

You represent and warrant that:

  • Your account information is accurate and maintained.
  • You have the necessary rights to authorize Living Disciple to use your Submitted Content.
  • Your Submitted Content does not infringe on third-party intellectual property rights.
  • You have the qualifications and expertise to teach and offer your services.
  • You will maintain a quality of service in line with industry standards.

You warrant that you will not:

  • Post inappropriate, offensive, or false content.
  • Send unsolicited advertising, spam, or solicitations.
  • Use the Services for any business other than teaching.
  • Engage in activities requiring third-party licenses or royalties.
  • Frame or embed the Services to circumvent them.
  • Impersonate others or access accounts without authorization.
  • Interfere with other instructors’ services or content.
  • Abuse Living Disciple resources, including support services.

2. License to Living Disciple

You grant Living Disciple the rights to offer, market, and modify your Submitted Content as detailed in the Terms of Use, including adding captions for accessibility. You also allow Living Disciple to sublicense these rights to third parties, such as students, resellers, distributors, affiliates, and through paid advertising.

You can remove your Submitted Content at any time unless otherwise agreed. Living Disciple’s right to sublicense will end for new users 60 days after removal. However, (1) rights granted to students before removal will continue and (2) Living Disciple’s right to use the content for marketing will survive.

We may record and use your Submitted Content for quality control and to deliver, market, promote, or operate the Services. You allow Living Disciple to use your name, likeness, voice, and image for these purposes, waiving any related rights to the extent allowed by law.

3. Trust & Safety

3.1 Trust & Safety Policies

You agree to follow Living Disciple’s Trust & Safety policies, Restricted Topics policy, and other content quality standards. Check these policies regularly for updates. Your use of the Services requires our approval, which we may grant or deny at our discretion.

We may remove content, suspend payouts, or ban instructors at any time, without notice, for reasons including:

  • Non-compliance with our policies or legal terms
  • Content not meeting quality standards or negatively impacting students
  • Behavior reflecting poorly on Living Disciple
  • Using marketers or partners who violate our policies
  • Engaging in unfair competition, such as off-site promotion against our policies

3.2 Co-Instructors and Teaching Assistants

The Living Disciple platform allows you to add co-instructors or teaching assistants for your Submitted Content. You must establish and follow Co-Instructor Relationship Rules and Guidelines. By adding them, you authorize them to take actions affecting your account and content. Their violations may impact your account and content. Living Disciple will not mediate disputes between you and these users. If co-instructors have a revenue share, it will be paid from your earnings based on the ratios set in your Course Management settings at the time of purchase.

3.3 Relationship to Other Users

Instructors don’t have a direct contract with students and only receive student information through the platform. You agree to use this data solely to provide services on Living Disciple and not to solicit or store additional personal data outside the platform. You agree to indemnify Living Disciple against any claims from your use of student data.

3.4 Anti-Piracy Efforts

We partner with anti-piracy vendors to protect your content from unauthorized use. By appointing Living Disciple and our vendors as your agents, we can enforce copyrights on your behalf through notice and takedown processes under applicable laws. We have primary authority to file copyright notices for you.

These rights remain unless you revoke them by emailing info@livingdisciple.org with the subject line: “Revoke Anti-Piracy Protection Rights” from your account email. Revocation takes effect 48 hours after receipt.

4. Pricing

4.1 Price Setting

When creating content for sale on Living Disciple, you will select a membership-level access from a list of available tiers or offer it for free.

For foreign currency purchases, we convert the membership price or promotional price using a system-wide rate set by Living Disciple, fixed periodically into a “Price Tier Matrix.” These rates may differ from the current market rate. We can update the Price Tier Matrix anytime. More information on pricing tiers is available here.

You allow us to share your content for free with our employees, selected partners, and to restore access for previous purchasers, without compensation.

4.2 Transaction Taxes

If a student purchases in a country where Living Disciple must remit sales, use, or value-added taxes (VAT), we will collect and remit those taxes to the appropriate authorities. We may increase the sale price to cover these taxes.

5. Payments

5.1 Revenue Share

When a student buys your content, we calculate the gross amount received (“Gross Amount”) and subtract any transaction taxes, mobile platform fees, an approximately 3% processing fee, and any promotional program costs to get the net amount (“Net Amount”).

Your revenue share is 50% of the Net Amount, minus any deductions like refunds. We will notify you 30 days in advance of any changes to this rate.

All payments are made in USD, regardless of the sale currency. Living Disciple isn’t responsible for currency conversion, wiring, or processing fees. Your revenue report will show the sales price in local currency and your revenue in USD.

5.3 Receiving Payments

To receive timely payments, you must have a PayPal, or U.S. bank account (for U.S. residents) in good standing and provide the correct associated email. You must also submit any necessary tax documentation (e.g., W-9 or W-8), and we may withhold taxes from your payments. Payments may be withheld if proper information or documentation is not provided. You are ultimately responsible for any taxes on your income.

Payments are made within 45 days of the end of the month when we receive the course fee or when course consumption occurred, depending on the revenue share model.

As an instructor, ensure you are eligible for payment by a U.S. company. We may withhold funds in cases of fraud, intellectual property violations, or other legal violations.

If we cannot transfer funds to your account within the period specified by unclaimed property laws, we may submit those funds to the appropriate government authority as required.

5.4 Refunds

You agree that students have the right to receive refunds as detailed in the Terms of Use, and instructors will not receive revenue from refunded transactions.

If a refund is issued after instructor payment, we may either (1) deduct the refund amount from the next payment to the instructor or (2) require the instructor to repay the refunded amount if no further payments are due or if payments are insufficient.

6. Trademarks

As a published instructor, you may use our trademarks with authorization.

You must:

  • Use only the provided trademark images and follow any published guidelines.
  • Use trademarks only for promoting your content on Living Disciple.
  • Stop using trademarks if requested.

You must not:

  • Use trademarks misleadingly or disparagingly.
  • Imply our endorsement of your content or services.
  • Use trademarks unlawfully or with inappropriate content.

7. Deleting Your Account

Instructions for deleting your instructor account can be found here. We will make reasonable efforts to process any remaining scheduled payments owed to you before deleting your account. Please note that if students have previously enrolled in your content, your name and content may still be accessible to them after your account is deleted. If you need assistance or encounter issues while deleting your account, please contact our Support Center.

8. Miscellaneous Legal Terms

8.1 Updating These Terms

We may update these Terms occasionally to clarify or reflect new practices, such as adding features. Living Disciple reserves the right to modify these Terms at any time. If we make significant changes, we will notify you via prominent means, such as email to your account address or a notice on our Services. Changes take effect on the posting date unless stated otherwise.

By continuing to use our Services after changes become effective, you accept the updated Terms. Revised Terms will replace all previous versions.

8.2 Translations

Any non-English version of these Terms is provided for convenience. You understand and agree that the English version is the controlling document in case of any conflict.

8.3 Relationship Between Us

You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.
